Will Trust: Trust Law Definition

A trust created by a persons will that comes into effect upon their death. Also called a testamentary trust. Common uses include providing for a surviving spouse while preserving assets for children, protecting assets for vulnerable beneficiaries, or managing inheritance for minors. Only becomes operative after probate.
