Constitution of a Trust: Trust Law Definition
The process of properly creating and funding a trust so it becomes legally effective. Requires: (1) a valid declaration of trust, and (2) actual transfer of property to the trustees. A trust is not fully constituted until the trust property is vested in the trustees. An incompletely constituted trust is generally unenforceable.
